Terms of Service

1. Provider

The AccessProof service ("Service") is provided by Romain Lacube, individual entrepreneur (EI) registered in France:

2. Acceptance

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

3. The Service

AccessProof scans websites you submit ("Sites") for WCAG 2.2 and ADA accessibility issues using axe-core, scores them, and produces reports. Plans, quotas, and features are described on the pricing page.

4. Account & eligibility

  • You must be 18 or older and capable of forming a binding contract.
  • You are responsible for keeping your credentials secure.
  • You may not share your account with other users; teams require multiple seats.
  • You must only scan websites you own or have explicit authorization to scan.

5. Acceptable use

You agree NOT to:

  • Use the Service to scan domains you do not control or are not authorized to assess.
  • Attempt to bypass rate limits, plan quotas, or scan limits.
  • Reverse-engineer, scrape, or resell the Service or its outputs without written consent.
  • Send abusive, illegal, or malicious content through the Service.
  • Probe or exploit the Service's infrastructure (penetration testing requires prior written authorization).

Violations may lead to immediate suspension or termination without refund.

6. Subscription & billing

  • Paid plans are billed monthly in advance via Stripe.
  • Prices are listed in USD on the pricing page; local taxes (if any) are added at checkout.
  • You can cancel at any time; cancellation takes effect at the end of the current billing period.
  • No refunds for partial periods or unused quotas.
  • Failed payments result in a 7-day grace period before account suspension.

7. Right of withdrawal (consumers in the EU)

By starting to use the Service immediately upon subscription, you expressly waive your 14-day right of withdrawal under Article L. 221-28 of the French Consumer Code (digital service fully performed before the end of the withdrawal period, with your prior consent).

8. Intellectual property

  • The Service, code, branding, and documentation are owned by Romain Lacube.
  • You retain ownership of the URLs you submit and any content reachable on those URLs.
  • Reports generated for you are yours to use freely (internal, client deliverable, public).
  • Aggregated, anonymized scan statistics may be used by us to improve the Service.

9. Service availability

We aim for 99.5% monthly uptime but do not guarantee uninterrupted Service. Scheduled maintenance is announced when possible. We are not liable for outages caused by upstream providers (hosting, DNS, payments).

10. Liability

The Service is provided "as is". To the extent permitted by law, our aggregate liability is capped at the total amount you have paid us in the 12 months preceding the claim. We are not liable for indirect damages (loss of revenue, data, reputation, or accessibility-related legal exposure).

AccessProof is a monitoring tool, not legal advice. Scan results help you identify accessibility issues; legal compliance with WCAG, ADA, RGAA, or any other regulation remains your responsibility.

11. Termination

You may delete your account at any time from settings. We may terminate or suspend your account for violations of these Terms with or without notice. Upon termination, your data is purged within 30 days, except invoices retained for legal accounting purposes.

12. Changes to the Terms

We may update these Terms. Material changes will be notified by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law & jurisdiction

These Terms are governed by French law. Disputes shall be subject to the exclusive jurisdiction of the courts of Aix-en-Provence, France, except where mandatory consumer protection rules require otherwise.
